What is Trust Deed Drafting & Registration in Bangalore?
A trust is an arrangement in which a person (the settlor or author of the trust) hands over property or money to trustees, who hold and manage it for the benefit of others (the beneficiaries). The trust deed is the document that creates the trust. It sets out its name, objects, the initial property or corpus, who the trustees are, how they are appointed and removed, what powers they have, how accounts are kept, and what happens if the trust is ever wound up. There are two broad kinds. A public trust (charitable, educational, medical or religious) benefits the public or a section of it. A private trust benefits named people, often family members, and is governed by the Indian Trusts Act, 1882. Under that Act, a trust of immovable property must be declared by a written, signed and registered instrument. In Karnataka, public charitable trusts are also created by executing a trust deed and registering it at the Sub-Registrar's office under the Registration Act, 1908. The registered deed is what banks, the Income Tax Department and donors will ask to see. Because the objects clause and the dissolution clause decide whether the trust can obtain tax exemption, and whether its assets are protected, the deed is worth drafting carefully the first time. It is not easy to amend later.
When Do You Need This Service?

- Formalising an existing informal charitable group so it can open a bank account and receive donations
- Preparing to seek CSR funding or institutional grants, which require a registered entity
Types of Trust Deed Drafting & Registration in Bangalore
Public charitable trust
For education, medical relief, relief of the poor, environment, or other objects of general public utility. This is the usual choice for an NGO that wants income-tax exemption and donor tax benefits.
Religious trust
To manage a temple, mosque, church or other place of worship and its donations. The objects must be drafted carefully if the trust also runs charitable activities.
Private or family trust
To hold property or investments for named beneficiaries, often for succession planning or to provide for a dependant. Governed by the Indian Trusts Act, 1882. Taxation depends on how the shares of beneficiaries are defined, so we recommend a tax review alongside the deed.
Trust deed amendment or supplementary deed
For an existing trust: changing trustees, objects or the registered address, within the powers the original deed allows.
Documents Required
- Proposed name of the trust and a clear description of its objects
- PAN and Aadhaar of the settlor and of every trustee
- Passport-size photographs of the settlor and trustees
- Address proof of the trust's registered office: a recent electricity bill or property tax receipt for the premises
- No-objection letter from the owner of the premises, if the office is not owned by the trust or the settlor
- Details of the initial corpus (the amount or property the settlor is settling on the trust)
- If immovable property is being settled on the trust: its title deed, khata and latest tax receipt, and encumbrance certificate
- Two witnesses with their Aadhaar for the registration day
Step-by-Step Process
Consultation
We discuss what the trust will do, who the settlor and trustees are, and whether a public trust, a private trust, a society or a Section 8 company best suits your plans, especially if you intend to seek tax exemption, CSR funds or foreign donations later.
Drafting the trust deed
An advocate on our panel drafts the deed: name, objects, corpus, trustees and their appointment and removal, powers, meetings, bank operation, accounts and audit, amendment, and a dissolution clause that keeps charitable assets for charitable purposes.
Review with the settlor and trustees
You read the draft, and we explain each clause and make the changes you need before anything is signed.
Stamp duty and Kaveri data entry
We work out the stamp duty under the Karnataka Stamp Act (it depends on whether property is being transferred to the trust), arrange the e-stamp, complete the Kaveri 2.0 data entry and book the Sub-Registrar appointment.
Registration at the Sub-Registrar
The settlor, the trustees who are signing, and two witnesses attend the Sub-Registrar's office for signatures, photographs and biometrics. The registered trust deed is issued after registration.
PAN, bank account and tax registrations
We apply for the trust's PAN, help open its bank account, and prepare the application for income-tax registration and approval for donor deductions (commonly called 12A and 80G), plus NGO Darpan registration where relevant.
Cost Factors
Pricing depends on several factors specific to your situation:
- Stamp duty under the Karnataka Stamp Act, which depends on whether money only, or immovable property, is being settled on the trust
- Registration fee and scanning charges at the Sub-Registrar, which are government charges
- Whether immovable property is being transferred to the trust, which adds title review and higher duty
- Whether PAN, bank account and income-tax registration support are included
- Sevantay's professional fee is quoted in writing after a short consultation, before any work starts
Transparent pricing: Your Sevantay professional will provide a clear cost estimate before starting work. You pay only after the service is completed to your satisfaction.

How this works in Bangalore
In Bengaluru, a trust deed is registered at the Sub-Registrar's office with jurisdiction over the trust's registered address (or over the property, if immovable property is being settled). The data entry and appointment go through Kaveri 2.0, and the settlor, signing trustees and two witnesses attend in person for photographs and biometrics.
Karnataka does not have a separate charity-commissioner registration for public trusts of the kind found in Maharashtra or Gujarat. The registered trust deed is itself the founding record, which puts even more weight on getting its objects, trustee and dissolution clauses right.
Stamp duty is payable under the Karnataka Stamp Act. A declaration of trust over money attracts a modest duty, while settling immovable property on the trust attracts duty linked to the property's value, so the corpus you choose affects the cost. We work out the duty before the e-stamp is bought, so the deed is neither under-stamped nor over-stamped.
Pro Tips from Our Experts
- Write the objects clause for what the trust will actually do, and be specific. Vague objects ("any charitable purpose") and objects that mix business activity with charity cause problems at the income-tax registration stage.
- Include a clear dissolution clause that sends remaining assets to another charitable organisation with similar objects, never back to the trustees or the settlor. This is one of the first things the tax authorities check.
- Provide for trustee succession: how a new trustee is appointed if one dies, resigns or is removed. A trust whose deed is silent on this can get stuck when it matters.
- Start with a money corpus unless you specifically need property in the trust. Transferring property adds title checks and stamp duty, and can be done later by a separate deed.
- Keep the trust's bank account and books separate from day one. Mixing trust money with personal funds is the most common reason trusts run into trouble.

Frequently Asked Questions
Is it compulsory to register a trust deed in Karnataka?
A trust of immovable property must be created by a registered instrument. For a trust that holds only money, registration is not strictly required by the Indian Trusts Act, but in practice every public trust registers its deed: banks, the Income Tax Department, donors and CSR partners all ask for the registered deed. We recommend registration in every case.
How many trustees does a trust need?
The law does not fix a minimum for a private trust, and a single trustee is possible. For a public charitable trust we recommend at least two, and usually three or more, so that decisions and bank operations do not depend on one person and the trust continues if a trustee dies or steps down.
What is the difference between a trust, a society and a Section 8 company?
A trust is created by a deed and run by trustees, often with the settlor's family in control, and it is the simplest to set up. A society is registered under the Karnataka Societies Registration Act, 1960, has members and a governing body, and suits membership organisations. A Section 8 company is registered with the MCA, has the most formal compliance, and is often preferred by large donors and foreign funders. We help you choose before drafting.
How long does it take to register a trust in Bangalore?
Drafting and review usually take three to five working days, depending on how quickly the objects and trustees are finalised. Registration is completed on the day of the Sub-Registrar appointment. PAN usually follows within one to two weeks, and income-tax registration after that.
Can the trust deed be changed after registration?
Only as far as the deed itself allows. A well-drafted deed includes an amendment clause (typically allowing changes to trustees and administrative provisions, but not to the core charitable objects). Changes are made by a supplementary deed, which is also registered. This is why the original deed should be drafted with care.
Will the trust automatically be tax-exempt?
No. Registering the trust deed creates the trust; it does not make its income tax-exempt. A charitable trust must apply separately to the Income Tax Department for registration (commonly called 12A) and, if donors are to get a deduction, for approval (commonly called 80G). The objects and dissolution clauses in the deed are examined in that process, which is another reason to draft them correctly.
Can a trust receive foreign donations?
Only with registration or prior permission under the Foreign Contribution (Regulation) Act (FCRA), which has its own eligibility conditions, including a track record of activity. A newly registered trust generally cannot receive foreign contributions straight away. We can advise on the path once the trust is set up.

Setting up a trust in Bangalore is straightforward on paper: draft a deed, stamp it, and register it at the Sub-Registrar. The work is in the drafting. The objects clause decides whether the trust can obtain income-tax exemption and donor deductions. The trustee clauses decide who controls the trust years from now. The dissolution clause decides what happens to its assets if it ever closes. A template deed downloaded from the internet usually gets at least one of these wrong, and a registered deed is not easy to change.
Sevantay's panel advocates draft your trust deed around what the trust will actually do. Our team then works out the Karnataka stamp duty, completes the Kaveri 2.0 data entry, books and attends the Sub-Registrar appointment with you, and follows through with the trust's PAN, bank account and income-tax registration. Charitable, educational, religious and family trusts are all covered, with one quote upfront and one point of contact from the first draft to the bank account.
